The Senate on Tuesday passed the bill on sexual harassment in tertiary institutions after reading it for the third time.
The bill titled: ‘A Bill for an Act to prevent, prohibit and redress Sexual Harassment of students in tertiary educational institutions and for matters concerned therewith, 2019’, was sponsored by the Deputy Senate President,. Ovie Omo-Agege, and 106 other senators.
Here is the break down of the content of the bill.
1. Any teacher/lecturer that engages in sexual intercourse with student or demands for sex from a student or a prospective student will face up to 14 years in prison or not less than five years, without fine.
2. Any teacher/lecturer that intimidate or creates hostile or offensive environment for student by asking for sex or makes sexual advances towards a student will face up to 14 years for prison or not less than five years, without fine.
3. Any teacher/lecturer that whistles or winks at any student or screams or exclaims or joke or make sexual compliment or uncomplimentary remark about any student body or stalks a student, will face up to five years jail term or not less than two years jail term
3. Any teacher/lecturer that grab, hug, kiss, rub or stroke or touch or pinch the breasts or hair or lips or hips or buttocks or any other sensual part of the body of a student, will face up to five years jail term
4 Any teacher/lecturer that displays, gives or sends by hand or courier or electronic or any other means naked or sexual explicit pictures or videos or sex related objects to any student will spend up to five years jail or not less than two years.
5. Any teacher/lecturer that orders or forces another person to commit any act of sexual harassment, or has a hand in any sexual harassment act by another person will face up to 14 years for prison or not less than 5 years, without fine.
6. Any administrative head that refuses to set up an Independent Sexual Harassment Prohibition Committee to investigate Sexual Harassment Complain with the permission of the management body of the school will be liable to pay fine of N5,000,000 or bag five years in prison, or both.
7. Any teacher/lecturer or staff of an institution that a report sexual harassment is reported to and victimizes the student that complained of Sexual Harassment will suffer the same punishment like the teacher/lecturer that was originally complained of.
8. Any administrative head that refuses to refer Sexual Harassment Complaint to an Independent Sexual Harassment Prohibition Committee in the institution for proper investigation, will liable of a minimum fine of N5,000,000 or imprisonment of at least two years, or both.
9. After investigation of any Sexual Harassment Complaint, and it is discovered that the accusation is false,
Such student could be suspended.
The bill will be transmitted to the House of Representatives for concurrence and then sent to the president for assent.
